Terms of Use (EULA) — Sleep Scene

These Terms of Use govern your use of Sleep Scene (“the App”). By downloading or using the App, you agree to these Terms.
1. License
We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple devices that you own or control, solely for your personal use and in accordance with these Terms and Apple’s App Store rules.
2. Purchase
Sleep Scene is offered as a one-time paid purchase through Apple’s App Store. All billing, payment processing, refunds, and related transaction matters are handled by Apple under Apple’s terms and policies.
3. Local-only data
Any content or settings you create in the App are stored locally on your device unless you choose to share or export them. You are responsible for safeguarding your device and any information stored on it.
4. Prohibited uses
You agree not to:
reverse engineer, decompile, modify, or redistribute the App except as permitted by law;
use the App for unlawful, harmful, or misleading purposes;
attempt to interfere with the App’s normal operation or access any non-public functionality.
5. Intellectual property
The App, including its design, text, graphics, audio, code, and other content, is owned by us and protected by applicable intellectual property laws. These Terms do not transfer any ownership rights to you.
6. Disclaimer of warranties
The App is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the App will be uninterrupted, error-free, or meet your expectations.
7. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, profits, or business arising out of or related to your use of the App. Our total liability for any claim relating to the App will not exceed the amount you paid to purchase it.
8. Indemnity
You agree to indemnify and hold us harmless from claims, damages, liabilities, and expenses arising out of your misuse of the App, your violation of these Terms, or your violation of any law or third-party rights.
9. Updates and availability
We may update, improve, modify, or discontinue features of the App at any time. Updates may be provided through the App Store. Continued use of the App after an update means you accept the updated version of the App and these Terms.
10. Termination
You may stop using the App at any time by deleting it from your device. We may terminate or suspend your license if you violate these Terms. Upon termination, the license granted under these Terms ends.
11. Governing law
These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-laws principles. If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.
12. Changes to these Terms
We may revise these Terms from time to time. When we do, we will update the “Last updated” date above. Continued use of the App after changes take effect means you accept the revised Terms.
