Terms of Use (EULA) — Your Esthi: Skin Coach

These Terms of Use govern your use of Your Esthi: Skin Coach (“the App”). By downloading or using the App, you agree to these Terms.

1. License

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple devices that you own or control, solely for your personal use and in accordance with these Terms and Apple’s App Store rules.

You may not copy, modify, reverse engineer, redistribute, sell, rent, or otherwise misuse the App except as permitted by law.

2. Free access, preview access, and paid features

Your Esthi includes a free Home experience and an app-managed 14-day preview of the full app.

The 14-day preview is not an Apple or StoreKit free trial. You do not need to choose a subscription plan upfront to begin using the preview.

After the preview ends, some areas remain available for free, such as Home browsing, Explore Concerns, select Skin Practice games, Profile/account access, Restore Purchases, and reading saved Esthi Notes.

Personalized and deeper coaching features may require an active subscription after the preview, including Skin Read, Routine, Chat with Molly, Progress, Check-Ins, Skin School, and certain Skin Practice games.

3. Subscription terms

Your Esthi offers auto-renewing subscriptions through Apple’s App Store.

Current subscription options:

  • Monthly: $9.99

  • Yearly: $45.99

Payment is charged by Apple to your App Store account. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing period, subject to Apple’s subscription terms and account settings.

You can manage or cancel your subscription through your Apple account settings. Refunds, billing issues, and cancellation requests are handled by Apple.

Your Esthi does not process payments directly and does not receive your full payment card information.

4. Skincare guidance only; no medical care

Your Esthi provides skincare education, routine support, progress guidance, and personalized coaching-style suggestions.

The App does not provide medical advice, medical diagnosis, medical treatment, emergency care, prescriptions, or a replacement for a dermatologist, physician, or other licensed medical provider.

The App may help you think through skincare routines, ingredients, habits, check-ins, and next steps, but it cannot diagnose skin conditions or guarantee results.

You should seek care from a licensed medical professional for severe, painful, worsening, infected, persistent, eye-area, allergic, or otherwise concerning symptoms.

5. Personal responsibility

You are responsible for:

  • the skincare products you choose to use;

  • checking product labels, ingredients, and directions;

  • patch testing when appropriate;

  • avoiding known allergens or irritants;

  • deciding whether a routine, step, protocol, or care plan is right for you;

  • following professional medical advice when needed; and

  • how you use any guidance or educational content provided by the App.

Results vary by person, skin history, product choice, consistency, environment, hormones, medication, allergies, and many other factors. We do not guarantee any particular skincare result.

6. Photos, video, and app captures

The App may allow you to add or capture photos, short videos, or product images for your own skincare record and routine guidance.

Your Esthi does not use photos or videos to diagnose medical conditions. Any capture features are for skincare context, documentation, and your personal app experience.

Do not upload or save content that you do not have the right to use.

7. User content

You may enter information such as skin concerns, goals, sensitivities, allergies, irritants, routine details, product-use information, progress check-ins, Esthi Notes, photos, videos, and chat messages.

You retain your rights to the content you enter. You allow us to use that content as needed to operate, maintain, personalize, and improve the App experience for you.

You are responsible for the accuracy, legality, and appropriateness of the information and content you provide.

8. Local data and reset

Your Esthi is designed to store your skincare profile, routines, progress, check-ins, Esthi Notes, chat history, and captures locally on your device in the current version.

The App may include a local reset option that clears local skincare data from the App on that device. Resetting local app data does not cancel your Apple subscription and does not necessarily reset your app-managed preview timing.

If you delete the App, change devices, or use Apple backup/restore tools, data behavior may depend on your device and Apple settings.

9. Prohibited uses

You agree not to:

  • use the App for unlawful, harmful, fraudulent, abusive, or misleading purposes;

  • upload content that infringes another person’s rights or violates applicable law;

  • attempt to access non-public systems, data, or functionality;

  • interfere with the App’s operation, security, or availability;

  • copy, modify, reverse engineer, decompile, or redistribute the App except as permitted by law;

  • use the App to provide medical diagnosis, medical treatment, or emergency guidance to others; or

  • use the App in a way that violates these Terms or Apple’s rules.

10. Intellectual property

The App, including its name, design, branding, lessons, Skin School content, Skin Practice content, text, graphics, layouts, code, icons, and other materials, is owned by us or our licensors and is protected by intellectual property laws.

These Terms do not transfer ownership of the App or its content to you.

11. App updates and availability

We may update, improve, modify, suspend, or discontinue features of the App at any time.

Some features may change over time as the App improves. Continued use of the App after updates means you accept the updated App and these Terms.

We do not guarantee that the App will always be available, uninterrupted, error-free, or compatible with every device or iOS version.

12. Third-party services

The App is distributed through Apple’s App Store and uses Apple systems for purchases, subscriptions, billing, refunds, and restore purchases.

Your use of Apple services is also subject to Apple’s terms and policies.

If the App later adds integrations, cloud sync, analytics, or third-party services, the Privacy Policy will be updated as needed.

13. Disclaimer of warranties

The App is provided “as is” and “as available.”

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, and availability.

We do not guarantee that the App will be suitable for every skin concern, routine, product, ingredient, or user.

14. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, goodwill, revenue, profits, or business arising out of or related to your use of the App.

To the fullest extent permitted by law, our total liability for any claim related to the App will not exceed the amount you paid for the App subscription during the 12 months before the event giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.

15. Indemnity

You agree to indemnify and hold us harmless from claims, damages, liabilities, losses, costs, and expenses arising out of or related to:

  • your misuse of the App;

  • your violation of these Terms;

  • your violation of applicable law;

  • content you enter or upload; or

  • your violation of any third-party rights.

16. Termination

You may stop using the App at any time by deleting it from your device. You are responsible for canceling any active subscription through your Apple account settings.

We may suspend or terminate access to the App if you violate these Terms or misuse the App.

Upon termination, the license granted under these Terms ends.

17. Governing law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles.

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.

18. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date.

Continued use of the App after changes take effect means you accept the updated Terms.
