Terms of Use — Your Esthi

These Terms govern your use of Your Esthi (“the App”). By downloading, accessing, or using the App, you agree to these Terms.
1. License
We grant you a limited, personal, non-exclusive, non-transferable, and revocable license to use the App on Apple devices that you own or control, subject to these Terms and Apple’s applicable rules.
The App is licensed, not sold.
You may not copy, distribute, sell, rent, sublicense, reverse engineer, interfere with, or misuse the App except where permitted by law.
2. Eligibility and accounts
Your Esthi is intended for adults.
The App does not require you to create an account. Features and saved content are generally associated with the local installation on your device.
3. Free access, preview, and subscriptions
Your Esthi may include free content, an app-managed preview period, and subscription-only features.
The app-managed preview is not an Apple or StoreKit free trial and does not require you to select a subscription before it begins.
Auto-renewing subscriptions are offered through Apple’s App Store. Prices and subscription periods are displayed before purchase.
Apple handles payments, renewals, cancellations, billing questions, and refunds. Subscriptions renew automatically unless canceled through your Apple account settings within the time required by Apple.
Deleting the App, resetting local data, or deleting Face Data does not cancel a subscription.
4. Skincare guidance only
Your Esthi provides skincare education, routine support, progress guidance, and coaching-style suggestions.
The App does not provide:
medical advice;
medical diagnosis;
medical treatment;
prescriptions;
emergency care; or
a replacement for a dermatologist, physician, or other licensed medical provider.
The App cannot diagnose a skin condition or guarantee a particular result.
Seek medical care for severe, painful, infected, persistent, worsening, allergic, eye-area, open-skin, or otherwise concerning symptoms.
5. Visual Check
Visual Check is an optional, on-device skincare feature.
It may use a selfie or a still frame from an optional short video to:
determine whether the image is usable;
locate facial skin regions;
measure visible image characteristics; and
provide cautious appearance-based observations.
Visual Check is not facial recognition, identity verification, biometric authentication, or medical diagnosis.
Results may be affected by:
lighting;
camera quality;
angle and distance;
motion or focus;
makeup, sunscreen, or skincare products;
facial expression;
image obstruction; and
differences between capture conditions.
Visual Check results are informational and may be unavailable when an image is not suitable.
Fitzpatrick type is not determined from an image.
6. Photos, videos, and Progress images
You may choose to take or select a selfie, short video, Progress image, or product image.
You must have the right to use any content you provide.
The primary Visual Check selfie is temporary and is not retained unless you separately choose to save a still image for Progress.
Optional video:
is short and silent;
is used only to select a still frame;
is not saved to Progress; and
is deleted after use.
Saving a Progress still requires a separate choice. You may delete individual Progress images or all saved Progress images through the App’s available controls.
Product photos are separate from Face Data and are not used for facial analysis.

7. Progress comparisons
When available, the App may compare a current analyzed still image with an earlier user-saved Progress still.
Comparisons are appearance-based and may be affected by differences in lighting, position, expression, camera settings, skincare products, and other capture conditions.
A comparison is not a medical evaluation and does not guarantee that a biological skin change has occurred.
8. Your responsibilities
You are responsible for:
choosing which information and media to provide;
reviewing product ingredients and directions;
avoiding known allergens and irritants;
patch testing when appropriate;
deciding whether a skincare product or routine is appropriate for you;
following professional medical advice;
using consistent capture conditions when comparing Progress images; and
using the App lawfully and responsibly.
Results vary based on individual skin, history, products, environment, consistency, hormones, medications, allergies, and other factors.
We do not guarantee any specific skincare result.
9. User content and local data
You retain your rights to the information and content you enter.
The App may process your content locally as needed to provide the features you choose.
You are responsible for the accuracy, legality, and appropriateness of your content.
Local content may be lost if you:
delete the App;
reset local data;
delete specific saved content;
lose or replace your device; or
change Apple backup or restore settings.
You are responsible for maintaining any separate copy you require.
10. Prohibited uses
You may not:
use the App for unlawful, fraudulent, abusive, harmful, or misleading purposes;
upload content that violates applicable law or another person’s rights;
attempt to access non-public systems or functionality;
interfere with the App’s security, performance, or availability;
use the App to provide medical diagnosis, treatment, or emergency guidance to others;
misrepresent Visual Check results as medical findings;
copy, modify, redistribute, or reverse engineer the App except where permitted by law; or
violate these Terms or Apple’s applicable rules.
11. Intellectual property
The App and its content—including its name, branding, design, code, lessons, Skin School material, Skin Practice material, text, graphics, icons, and layouts—are owned by us or our licensors and are protected by intellectual-property laws.
These Terms do not transfer ownership of the App or its content to you.
12. App updates and availability
We may update, improve, modify, suspend, or discontinue App features.
We do not guarantee that the App will always be available, uninterrupted, error-free, or compatible with every device or operating-system version.
Continued use after an update means you accept the updated App and applicable Terms.
13. Apple and third-party services
The App is distributed through Apple’s App Store and may use Apple services for purchases, subscriptions, permissions, sharing, diagnostics, and restore purchases.
Your use of Apple services is subject to Apple’s terms and policies.
The agreement governing Your Esthi is between you and the App provider, not Apple. Apple is not responsible for providing maintenance or support for the App.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce applicable provisions relating to the App.
14. Disclaimer of warranties
The App is provided “as is” and “as available,” to the fullest extent permitted by law.
We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, and availability where legally permitted.
We do not guarantee that:
the App will meet every user’s needs;
every image can be analyzed;
every observation will be available or accurate;
Progress comparisons will reflect biological change; or
a skincare routine or product will produce a particular result.
Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.
15. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of data, goodwill, revenue, or profits arising from use of the App.
To the fullest extent permitted by law, our total liability for a claim related to the App will not exceed the amount you paid for the App during the 12 months before the event giving rise to the claim.
Some jurisdictions do not allow certain liability limitations, so some limitations may not apply to you.
16. Indemnity
You agree to indemnify and hold us harmless from claims, damages, losses, liabilities, costs, and expenses arising from:
your misuse of the App;
your violation of these Terms;
your violation of applicable law;
content you provide; or
your violation of another person’s rights.
17. Termination
You may stop using the App at any time.
You are responsible for canceling any subscription through your Apple account settings.
We may suspend or terminate access when you violate these Terms or misuse the App.
When these Terms terminate, the license granted to you ends.
18. Governing law
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles.
If any provision is found unenforceable, the remaining provisions remain in effect.
19. Changes to these Terms
We may update these Terms when the App or applicable requirements change.
The “Last updated” date will identify the current version. Continued use after updated Terms take effect means you accept them.
